Section 8 in Georgia: three things that work differently

Private landlords can legally say no. Georgia has no statewide law protecting voucher holders from source-of-income discrimination. Atlanta passed one in 2020, but the city has not enforced it because Georgia law bars cities from expanding fair-housing protections beyond the state’s list; a narrower 2022 Atlanta rule only covers properties that take city funding. The practical move: ask the housing authority that issues your voucher for its list of landlords already renting to voucher holders, rather than cold-calling listings.

The state agency IS where most of Georgia applies. The Georgia Department of Community Affairs runs the Housing Choice Voucher program in 149 of Georgia’s 159 counties through two regional offices; only 10 counties — including the big metro authorities like Atlanta Housing — are served by their own local housing authority. Check which one covers the county where you want to live before you apply.

Moving within DCA’s 149 counties is not a "move" at all. Because one agency covers most of the state, relocating between its counties is an internal transfer rather than a formal port. Crossing into one of the 10 local-authority areas (or leaving Georgia) uses federal portability rules instead — allowed everywhere the program runs, but if you did not live in the issuing authority’s area when you applied, you may have to lease within its jurisdiction for the first 12 months before porting out.
